This privacy statement applies to the website www.facelytix.com, run by FACELYTIX NV (referred to hereafter as ‘we’ or ‘us’). We take care of your privacy and hereby always act in accordance with the provisions of the Belgian Privacy legislation.

2. Definitions

 

  • Cookies’ means small files which are sent to your computer when you visit a website and which are filed on the browser of the hard disk of the user’s computer;

 

  • Personal data’ means any information relating to the identified or identifiable natural person;

 

  • Processing personal data’ means any operation or set of operations relating to personal data, (which may or may not be performed by automated procedures, such as the collection, recording, organisation, storage, update, change, retrieval, consultation, use, disclosure by transmission, dissemination or making available by any other means, coordination, combination, blocking, erasure or destruction of personal data);

  • Biometric data’ means data on a person’s behavioural and physiological characteristics. Facelytix works with video interviews and biometric data are the data that can be abstracted from video material. Such characteristics are facial expressions, non-verbal speech, body language, language use and physiological characteristics;

 

  • Processing biometric data’ means any operation or set of operations relating to biometric data, (which may or may not be performed by automated procedures, such as the collection, recording, organisation, storage, update, change, retrieval, consultation, use, disclosure by transmission, dissemination or making available by any other means, coordination, combination, blocking, erasure or destruction of accompanying personal data);

 

  • Processor’: means the natural person, the legal person, the de facto association or the public authority who or which processes personal data on behalf of the controller, excluding persons who are authorised to process the data under the direct authority of the controller;

 

  • Processing controller’ means any natural person, legal person, de facto association or public authority who or which, either alone or together with others, determines the objectives and the legal and technical means for processing personal data;

 

  • Affiliated Company’ means an affiliated company, as defined in Article 11 of the Companies Code, of Facelytix.

 

3. Aim of the data collection

Facelytix NV is a high-tech HR company. We work on the future of job applications and interviews and are developing software that can deduce personality from a video interview. The aim of this data collection is to research how we can develop an optimum model to deduce personality from video material. For the purposes of developing a model that is as correct as possible, we must examine on which parameters the model depends, e.g. age, education, etc.

Your data are only used for research to further develop and improve Facelytix NV software products. Participating in the research has no further consequences whatsoever for your future.

 

4. Processing your data

 

On the one hand, your data are processed to develop a model as outlined in point 4 and, on the other hand, for data analysis. For this purpose, the biometric data as described in the definition are abstracted from the video material.

 

 

5. The personal data processor/controller

5.1 Facelytix as processor

 

Facelytix is regarded as a processor of the personal and biometric data to the extent that it processes the data as instructed by partners and users.  In this case, Facelytix tries to take the adequate organisational and technical security measures necessary to protect personal data against fortuitous or unlawful destruction, against fortuitous loss and against changes or access to the data and any other prohibited form of processing your data.

 

5.2 Facelytix as data controller

 

Facelytix is regarded as data controller where it determines the purpose of and the means for the processing of personal and biometric data. It is only in the case where FACELYTIX acts in the capacity of data controller that points 6 to 10, inclusive, apply to this privacy statement.

 

6. Which data are processed?

 

On the one hand, the personal data processed by Facelytix are the data that you send us, which may or may not be as requested by our partner, when you use our website and our platform (by answering questionnaires, for example) and, on the other hand, the data that we receive from you based on your surfing and clicking behaviour.

The biometric data processed by Facelytix are any behavioural and physiological characteristics that can be deduced from a video interview.

 

7. Purposes for which the data are processed

 

FACELYTIX NV processes the personal data of and answers by respondents (employees, job applicants, freelancers and others) for the following purposes:

  • to provide the person involved access to his or her user profile and the accompanying functionalities;

  • to offer, provide, maintain and improve our service provision, including offering information and sending newsletters;

  • to use personal data for data analysis, software development and improvement of the Facelytix products;

  • to transmit (anonymised) personal data to research bodies and affiliated companies, namely Thalento nv, Prato nv, Stearn nv, Actonomy nv, etc. and only within the scope of research into the further development and improvement of Facelytix NV products;

  • for the processing of historical, statistical or scientific purposes;

  • to transmit data to the competent authorities at their express request.

  • to guarantee the adequate technical functioning of our website and platform;

  • to detect fraud, mistakes and/or criminal conduct and to provide protection against these.

 

FACELYTIX NV processes the video material for the following purposes:

  • to provide the person involved access to his or her video;

  • to abstract biometric data from his or her video;

  • to use biometric data to analyse data and develop and improve Facelytix products;

  • to transmit (anonymised) personal data to research bodies and affiliated companies, namely Thalento nv, Prato nv, Stearn nv, Actonomy nv, etc. and only within the scope of research into the further development and improvement of Facelytix NV products;

  • for the processing of historical, statistical or scientific purposes;

  • to transmit data to the competent authorities at their express request.

 

8. Rights of the person involved

 

8.1 Guarantee of lawful and secure processing of personal and biometric data

 

FACELYTIX NV always processes personal and biometric data honestly and lawfully and only for the aforementioned expressly outlined and legitimate purposes.

 

FACELYTIX NV has incorporated adequate technical and organisational security measures to protect the privacy of your data and to guarantee you that they are processed safely.

 

Although FACELYTIX NV has incorporated organisational and technical security measures to protect the privacy of your data, it cannot guarantee the security or confidentiality against hackers, others or security defects.

 

8.2 Right to perusal and correction

 

Only if FACELYTIX NV is the data controller of your personal data do you have a free right of perusal and correction of your personal data vis-à-vis FACELYTIX NV. You can exercise this right by contacting us by way of the contact data stated above, on condition that you sufficiently identify yourself.

 

8.3 Right to object to the use of data for direct marketing

 

You can object free of charge to the processing of personal data if the processing is done with a view to direct marketing. You can exercise this right by contacting us by way of the contact data stated above.

 

8.4 Right to data deletion

 

In view of the fact that your data are exclusively used for research to further develop and improve Facelytix software products and for long-term research, they can only be deleted after a minimum of 2 years. Your surname, first name and email address can be deleted any time you request this. You can have the personal data concerning you deleted if they are no longer necessary for the purposes for which they were collected or processed in any other way if you withdraw your processing permission and there are no other prevailing processing grounds, if the personal data have been processed unlawfully or if deleting personal data is necessary to comply with a statutory obligation. You can exercise this right by contacting us by way of the contact data stated above.

 

9. Transmitting data to third parties

 

Transmitting personal data to countries outside the European Union is only allowed if those countries guarantee the same protection level when processing the personal data and where the same or similar provisions as those in the Belgian Privacy Law apply. We guarantee that there shall be no transmission to third countries unless the measures necessary to meet the protection requirements laid down in the Belgian privacy legislation have been taken.
